  • It is raised in this period in other cases, depending on the location of the property, when some administrative structures or specialized bodies must be consulted.

Fourth: The period of validity of the building permit, its extension, and conditions for its renewal:

  • The validity of the building permit is for three years, starting from the date of its delivery.
  • The validity of the permit is extended for the same period as soon as a request is submitted for the purpose, in the form of if there is no change in the construction project, and the request must reach the municipality one month before the expiration date of the validity of the decision of the building permit
  • whose validity is to be extended.
  • The license will be renewed in the same terms and conditions that were granted if there is a change in the construction project.

Fifth: The list of works aimed at introducing normal and necessary changes or repairs to an established building that is not subject to construction permits:

The following works are not subject to building permits, with the exception of those related to buildings located within cultural sites and historical and traditional groups, whether arranged or not arranged under the title of a preserved area, as well as those of interest to historical monuments and protected or arranged buildings, and what is subject to special legislative and arrangement provisions:

Works relating to changes to a Maqam Building:

  • Enlarged internal openings,
  • Paving inside buildings,
  • Orchard floors are paved or cemented,
  • Putting protective iron for doors and windows with respect for the special arrangements that may result from that,
  • Laying water sides,
  • The health supply situation,
  • Concentrating heating appliances,
  • Placing electrical equipment inside buildings or parks,
  • Install potable water channels inside buildings or gardens,
  • Placing gas pipelines inside buildings or parks,
  • Putting gutters to let rain water fall inside buildings or gardens,
  • Laying channels to drain rain and wastewater inside buildings or gardens.

Works aimed at introducing repairs to an erected building:

  • Fix slopes of surfaces,
  • Building repairs to ensure grip to avoid water leakage,
  • Reconstruction of roofs if the building is not covered by a new restoration,
  • Reconstruction of floors and wall cladding,
  • Re-coatings inside and outside the stores,
  • Interior painting and calcining of buildings,
  • Painting and calcining the façades, while respecting the special arrangements that may result from that.
  • Repair of walls and interior walls without changing focus if the building is not covered by a new restoration,
  • Repainting to seal the cracks,
  • Repair electrical equipment,
  • Repairing drinking water canals,
  • Gas pipeline repair,
  • Repair of rainwater and wastewater drainage channels.

Notice:

The necessary measures must be taken when erecting buildings, especially those that are high and adjacent to old structures that are threatened with collapse, and take into account the condition and status of these structures and the negative and dangerous repercussions that may result from that threaten the lives of residents and harm existing structures.

 

First: The list of documents required to create a building permit file in order to set up a construction project for a dangerous, unhealthy and disturbing establishment (such as industrial establishments, factories, warehouses, fuel stations, workshops ...):

  • An application on plain paper in the name of the mayor signed by the permit applicant (explaining in particular the address of the correspondence and the subject of the application).
  • A certificate of ownership (original and the date of its issuance does not exceed three months) or an entitlement ruling or other document regarding the applicant's ownership of the property that is the subject of the license (you meet the legal requirements).
  • The receipt for the declaration of income tax or corporate tax.
  • A certificate of release in the salvation of the municipality fees that are employed on the real estate subject of the application.
  • Example of a surveyor raising that determines land levels and an elevation section in the case of building with sloping land prepared by a recognized surveyor engineer.
  • A construction project in six (6) peers in conformity with the architectural arrangements to which the real estate subject of the application belongs, prepared by an architect drawn up in the schedule of the Deanship of Architects, in which he also clarifies the conditions of safety, fire prevention and sanitation.
  • A comprehensive preventive study that clarifies the quality of activity and its impact on public safety and the necessary conditions for fire prevention prepared by a qualified body for the purpose or a specialized engineer drawn up at the Deanship of Engineers.
  • An example of the load-bearing structure of a building prepared by a qualified study office for the purpose or by a specialized engineer drawn up in the schedule of the Deanship of Engineers, to be submitted after the final approval of the project.
  • The arrangement of the establishment or the decision to exploit a datum by the interests of the ministry in charge of industry.
  • Approval of the National Agency for Ocean Protection.

Second: When required, and according to the location of the property and the type of exploitation, the file must be completed with the following documents:

  • The approval of the Minister charged of Agriculture in the event of the establishment of industrial, commercial or service facilities linked to agricultural exploitation in addition to the licenses provided for in the legislation in force,
  • Approval of the Regional Commission for Agriculture in the event of the construction of residential buildings in agricultural exploits,
  • A landing decision issued by the Regional Administration for Equipment, Housing and Land Planning in Tunisia in the event that the building is located next to the public domain of the roads or the maritime public domain or along the valleys within the urban areas.
  • Approval of the Civil Aviation Bureau and airports in the event of construction near the airport.
  • The example of the laying down of the exploiting establishment (the Tunisian National Railways Company or the Light Metro Company ...), in the event of a building being erected or altered by a building located along the public domain of the railways.

Third: The deadlines for submitting a building permit:

A decision on the licensing application shall take place within a period not exceeding forty-five (45) days from the date of filing a file for the full-fledged purpose.
It is raised in this period to:

  • Sixty (60) days if the initialization example is being prepared.
  • Ninety (90) days if the property is arranged or maintained or within the limits of two hundred (200) meters around natural sites, cultural sites, archaeological sites, preserved areas, or historical monuments.
  • And it is raised in this period in other cases, depending on the location of the property, when some administrative structures or specialized bodies must be consulted.
